<title>Imminent Cybercrime Threat to US Health Care Providers</title>

In a joint advisory, the Cybersecurity and Infrastructure Security Agency (CISA), FBI and the U.S. Department of Health and Human Services (HHS) said they have "credible information" that cybercriminals are taking new aim at health care providers and public health agencies as the COVID-19 pandemic reaches new heights. "Malicious cyber actors" may soon be planning to "infect systems with Ryuk ransomware for financial gain" on a scale not yet seen across the American healthcare system. Hospitals, physician practices, and public health organizations should take "timely and reasonable precautions to protect their networks from these threats." Malware targeting techniques often lead to “ransomware attacks, data theft, and the disruption of healthcare services." The restart includes providers who had their revalidation dates extended as outlined above as well as those providers regularly scheduled for revalidation beginning October 1, 2020 and forward.                         <p><span style="color: #1f497d;">While Florida Law previously required physicians to discuss non-opioid alternatives with patients prior to administering or prescribing a Schedule II opioid and provide a copy of the state-approved educational pamphlet on non-opioid alternatives, a new law passed in 2020 (HB 743) that makes some slight changes to the law and REQUIRES a printed copy of the pamphlet to be provided.<b>The new law, effective July 1, 2020, will no longer enable physicians to provide the pamphlet electronically</b>.While we actively lobbied against this measure, ultimately the Legislature did mandate printed copies be provided.</span><span style="color: #403f42;"> </span></p>

Telehealth providers must practice in a manner consistent with his or her scope of practice and the prevailing professional standard of practice for a health care professional who provides in-person health care services to patients in Florida. The applicable board, or department if there is no board, may adopt rules related to telehealth that further clarify practice standards.</span></p>

<p><strong><span>Patient Evaluations</span></strong><span><br />
If a telehealth provider conducts a patient evaluation sufficient to diagnose and treat the patient, the telehealth provider is not required to research a patient’s medical history or conduct a physical examination before using telehealth to provide health care services.</span></p>

<p><strong><span>Patient Medical Records</span></strong><span><br />
Telehealth providers must use the same standard of maintaining patient medical records as used for in-person services. They must also keep medical records confidential, as required in ss. 395.3025(4), F.S.</span></p>

<p><strong><span>Controlled Substances Prescribing</span></strong><span><br />
A telehealth provider may only use telehealth to prescribe a controlled substance for the following: </span></p>
<ul style="list-style-type: disc;">
    <li style="color: black;"><span>the treatment of a psychiatric disorder; </span></li>
    <li style="color: black;"><span>inpatient treatment at a hospital licensed under Ch. 395, F.S.; </span></li>
    <li style="color: black;"><span>the treatment of a patient receiving hospice services as defined in s. 400.601, F.S.; or</span></li>
    <li style="color: black;"><span>the treatment of a nursing home resident as defined in s. 400.021, F.S.</span></li>
</ul>
<p><strong><span>Out-of-State Telehealth Provider Registration Requirements</span></strong><span><br />
Health care practitioners with an out-of-state license or certification that falls under section 456.47(1)(b), F.S, qualify for an out-of-state telehealth provider registration number when they meet the following requirements:</span></p>
<ul style="list-style-type: disc;">
    <li style="color: black;"><span>Submit the completed Application for Out-of-State Telehealth Provider Registration;</span></li>
    <li style="color: black;"><span>Maintain an active, unencumbered license from another state, the District of Columbia, or a possession or territory of the United States;</span></li>
    <li style="color: black;"><span>Not have a pending investigation, discipline, or revocation on your license within the last five years;</span></li>
    <li style="color: black;"><span>Designate a duly appointed registered agent for service of process in Florida; </span></li>
    <li style="color: black;"><span>Maintain liability coverage or financial responsibility for telehealth services provided to patients in Florida in an amount equal to or greater than Florida health care practitioner requirements;</span></li>

Telehealth is the use of synchronous or asynchronous telecommunications technology by a telehealth provider to provide health care services, including, but not limited to, the assessment, diagnosis, consultation, treatment, and monitoring of a patient; transfer of medical data; patient and professional health-related education; public health services; and health administration. Telehealth <strong><u>does not</u></strong> include audio-only telephone calls, e-mail messages, or fax transmissions.</span></p>

<p><strong><span>Are there any exemptions from registering as an out-of-state telehealth provider?</span></strong><span><br />
There are two exemptions that allow an out-of-state licensee to perform telehealth for Florida patients without registering:</span></p>

    <li style="color: black;"><span>In response to an emergency medical condition, which is defined in s. 395.002, F.S.</span></li>

<p><strong><span>Can Florida health care practitioners register as an out-of-state telehealth provider?</span></strong><span><br />
Telehealth provider registration only applies to health care practitioners who are licensed in another state, the District of Columbia, or a possession or territory of the United States. Florida licensees can already provide telehealth services to patients in Florida that they can treat in person. If a Florida licensee would like to provide telehealth services to a patient outside of Florida, they must review the laws and rules in the location of the patient.</span></p>

<title>Information on Nonopioid Alternatives for the Treatment of Pain Pamphlet</title>

<description><![CDATA[<p>House Bill 451, Nonopioid Alternatives, was approved by Governor DeSantis and is effective July 1, 2019. The bill requires that before providing anesthesia or prescribing, ordering, dispensing, or administering an opioid listed as a Schedule II controlled substance to treat pain, the patient must be informed about available nonopioid alternatives.&nbsp;<br />
<br />
A healthcare practitioner will discuss the advantages and disadvantages of using nonopioid alternatives. Under the new law, the department is required to develop an educational pamphlet about using nonopioid alternatives and post the pamphlet on the department’s website. Healthcare practitioners must provide the patient with this educational pamphlet. Those healthcare practitioners providing emergency services and care are exempt from these requirements.<br />

<p>Florida Governor, Ron DeSantis, has signed HB 843 into law which expands the length-of-stay in Ambulatory Surgery Centers in Florida to 24-hours.&nbsp; &nbsp;The bill takes effect July 1, 2019.&nbsp;&nbsp; </p>
<p>&nbsp;</p>
<p>he Board of Medicine will have to develop rules to govern Pediatric Patients staying past midnight.&nbsp; Until those rules are in effect, pediatric patients cannot stay overnight.&nbsp; </p>
<p>&nbsp;</p>

<title>FOS Takes Action to Protect Patients and Prevent Federal Fee Schedule</title>

<description><![CDATA[<p>&nbsp;</p>
<p>The FOS urges Senators to oppose portions of Lower Health Care Costs Act (S.1895)<span style="color: #1f497d;">. </span>S.1895 would benchmark all out-of-network reimbursements to a median commercial in-network rate for the geographic area. </p>
<p>&nbsp;</p>
<p>This would impact all patients and physicians, including those in-network, as insurers will have no reason to continue contracts with physicians that are above the median rate. </p>
<p>&nbsp;</p>
<p>The federal government would be setting a ceiling for reimbursement that doesn’t take into account the quality of patient care and that insurers could systematically drive down without any opportunity for negotiation.&nbsp;</p>
<p>&nbsp;</p>
<p>This legislation will encourage insurers to further narrow their networks limiting in-network access to care for patients.&nbsp; </p>
