<title> Moratorium on Enrollment of New Durable Medical Equipment, Prosthetics, Orthotics, and Suppliers</title>

<description><![CDATA[<p style="text-align: center;"><em>The following is a release from the State of Florida Agency for Health Care Administration:<br /></em><strong><br />Florida Medicaid Health Care Alert<br />March 25, 2026<br /><br />Provider Type(s): ALL<br />Moratorium on Enrollment of New Durable Medical Equipment, Prosthetics, Orthotics, and Suppliers</strong></p><p style="text-align: justify;"><br /><br />On February 27, 2026, The Centers for Medicare &amp; Medicaid Services (CMS) imposed a 6-month nationwide moratorium on the <strong>Medicare</strong> enrollment of New Durable Medical Equipment, Prosthetics, Orthotics, and Supplies (DMEPOS) medical supply companies. A copy of the moratorium can be found <a href="https://www.federalregister.gov/documents/2026/02/27/2026-03971/medicare-medicaid-and-childrens-health-insurance-programs-announcement-of-nationwide-temporary" target="_blank">here</a>.<br /><br />The goal of the temporary moratorium is to fight fraud and safeguard taxpayer dollars, while ensuring patient access to care. Authority to impose such moratoria was included in the Affordable Care Act, and the Agency for Health Care Administration (Agency), with the approval from CMS, is exercising that authority at this time.<br /><br />Effective March 20, 2026, the Agency has imposed a temporary <strong>Medicaid</strong> moratorium on enrollment of new Durable Medical Equipment DME providers (Provider Type 90) in all Florida counties.<br /><br />Exclusively for purposes of the moratorium's applicability, a medical supply company is considered a business whose principal function is to furnish durable medical equipment and medical supplies (regardless of supply type) directly to another party, such as, but not limited to: (1) recipients with a medical order (for example, via mail order); (2) medical providers and suppliers; or (3) both. A pharmacy, hospital, or other medical provider that also provide DME as a secondary function are not part of this moratorium.<br /><br />The statewide moratorium will remain in place for an initial 6-month period. Under the moratorium, the Agency will not accept any new applications for DME providers for Florida Medicaid enrollment that are received after March 20, 2026. The Agency will continue processing DME provider applications submitted on or before March 20, 2026.<br /><br /><strong>No Medicaid recipients will go without the services they need</strong>. If any recipient is having difficulty accessing services, please encourage them to contact the Florida Medicaid Helpline at (877) 254-1055.<br /><br />All existing DME providers can continue to deliver and bill for authorized services.</p>]]></description>

<title>AMA: Potential for Limitations on Telehealth Services if Congress Does Not Act by October 1st</title>

<description><![CDATA[<p style="text-align: center;"><strong><span style="font-size: 20px;">A Message from the AMA: Potential for Limitations on Telehealth Services if Congress Does Not Act by October 1st</span></strong></p><p style="text-align: left;">The American Medical Association (AMA) has long called for Congress to enact legislation that would: (1) permanently allow Medicare patients in every geographic area, not just patients in rural areas, to receive telehealth services by waiving the geographic restrictions in current law; and (2) permanently allow Medicare patients to receive telehealth services in their homes instead of having to go to a medical facility to receive telehealth from a distant site. To date, however, Congress has passed legislation that only temporarily waives these requirements. Most recently, in March 2025 Congress extended these telehealth flexibilities for a six-month period that ends Sept. 30, 2025.<br /><br />Physicians who provide telehealth services to Medicare patients should be aware that if Congress is not able to pass legislation before Oct. 1, 2025, that extends government funding, then the current Medicare telehealth flexibilities will lapse. This means that telehealth services would be limited to rural areas as they were before the COVID public health emergency and that patients would not be able to receive telehealth services in their homes. In addition, the ability to provide audio-only services to Medicare patients would lapse, as would the Acute Hospital Care at Home program.<br /><br />In past government shutdowns, whenever Congress passed legislation to reopen the government, it made the funding and policies retroactive to the effective date of the shutdown. Physician practices may want to consider adjusting their patient schedules for telehealth services, however, as neither the likelihood nor the duration of a shutdown are known.</p>]]></description>

<title>Florida Governor Signs Historic Workers&apos; Compensation Legislation Into Law</title>

<description><![CDATA[<p style="text-align: center;"><strong><span style="font-size: 20px; color: #00853e;">Florida Governor Signs Historic Workers' Compensation Legislation Into Law</span></strong><br /><em>Florida Orthopaedic Society Delivers Major Investment in Treatment of Injured Workers</em></p><p style="text-align: justify;"><em></em><br />June 14, 2024, will be remembered as the date that the Florida Orthopaedic Society finally ended decades of underfunding treatment of injured workers in the State of Florida.<br /><br /><strong><span style="color: #00853e;">What Does this Mean for You?</span></strong><br /><br />In January 2025, starting with the implementation of the new physician fee schedule for Workers' Compensation, physicians will receive an increase in reimbursement from 110% of Medicare to 175% of Medicare for non-surgical codes, and an increase from 140% of Medicare to 210% of Medicare for surgical codes.  That represents an unprecedented increase in physician reimbursement of 59% for non-surgical codes and 50% for surgical care.  In addition, starting in January, your expert witness fees in Workers' Compensation will increase 50%, from $200 to $300.<br /><br />Florida has endured the lowest reimbursement for physicians treating Workers' Compensation in the country for over 25 years.  While reform passed in 2003 provided an increase in reimbursement, Orthopaedic Surgeons in Florida still trailed their colleagues in other states significantly as documented by the Workers' Compensation Research Institute.  All of that changed last Friday, after years of engagement and steadfast determination, the Governor has signed a bill to take effect on January 1, 2025, that will significantly increase reimbursement for physicians in the Workers' Compensation program.<br /><br />The Florida Orthopaedic Society led this initiative with support in the final stages by the Florida Medical Association. Through the commitment of our physician leaders and talented lobbying team and staff, we have delivered for all orthopaedic surgeons and injured workers in this state. <title> CMS News: Stay of Enrollment</title>

A stay of enrollment is a preliminary, interim status representing a pause in enrollment during which you will not be paid.<br /><br />During a stay of enrollment, or pause, your provider status remains active in Medicare, but Medicare will reject all claims submitted with a date of service within the stay period.<br /><br />Some examples of when a stay of enrollment may be implemented:<br /></p><ul><li style="text-align: justify;">Provider failed to timely report a change in address</li><li style="text-align: justify;">Supplier didn't respond to a revalidation request</li><li style="text-align: justify;">Independent diagnostic testing facility failed to comply with a supplier standard</li><li style="text-align: justify;">A supplier failed to timely report a change in address of an organizational owner</li><li style="text-align: justify;">A supplier failed to report the deletion of a managing employee</li></ul><p style="text-align: justify;"><br />Note: If a stay of enrollment has been placed on your enrollment record, you will be notified by hard-copy mail, email, and fax, if applicable. To have the stay of enrollment removed, you must fix the non-compliance with Medicare by submitting the applicable Medicare application. Remember, if you need help, Acevedo Consulting has the expertise to assist with Medicare enrollment.<br /><br />For example: Your clinic group practice recently changed practice locations and did not notify Medicare. Your MAC implemented a stay of enrollment because you did not report a change in practice location. To have the stay of enrollment removed and be able to continue billing Medicare, you will have to submit a change of information enrollment application to update your practice address.<br /><br />If you believe you meet all provider enrollment requirements and the stay of enrollment should not have been imposed, you can submit a provider enrollment rebuttal. <title>Florida Orthopaedic Society Statement on Passage of SB 362</title>

<description><![CDATA[<p style="text-align: justify;">(March 8, 2024) – The Florida Orthopaedic Society is extremely pleased the Florida Legislature has passed legislation that will significantly expand access to care for Florida’s injured workers. We would like to thank those legislative champions, including Senator Jennifer Bradley and Representatives Dan Daley and Chip LaMarca, who expertly guided the legislation through the process, garnering broad bipartisan support for this important legislation.  <br /><br />Workers' compensation patients are some of the costliest patients to treat in terms of practice expense given the large administrative and legal requirements, yet reimbursement for physicians treating injured workers had not increased in twenty years. According to data available from the Workers' Compensation Research Institute (WCRI), reimbursement for physicians treating injured workers in Florida is the lowest in the nation.  <br /><br />Because of that fact, WCRI data further indicates that Florida has some of the lowest physician participation rates in workers' compensation in the nation. The combination of high cost and low reimbursement has resulted in many physicians leaving the system. <br /><br />With a limited number of physicians accepting workers' compensation, many injured workers experience difficulty in accessing medical care, therefore delaying their return to function and increasing indemnity costs and lost productivity for Florida businesses.  <br /><br />There was broad consensus from stakeholders that the physician fee schedule needed to be addressed.  That was illustrated in the 2019 report from the Florida Division of Financial Services Three Member Panel, which concluded, “Data from the WCRI, NCCI, and the Division of Workers’ Compensation reflect Florida’s percentage of Medicare rates are at or near financial inadequacy for the purposes of reimbursing physicians for directly treating injured workers.”<br /><br />SB 362 addresses this situation by increasing physician reimbursement in Workers' Compensation to 210% of Medicare for surgery and 175% of Medicare for non-surgery codes and increases the hourly rate for expert testimony, thereby encouraging more physicians to willingly accept injured workers. <description><![CDATA[We are extremely pleased to report that <strong>Senate Bill 362</strong> by <strong>Senator Bradley</strong> passed unanimously out of its final committee of reference on Wednesday, <strong>Senate Fiscal Policy</strong>.  For those keeping score at home, that is now four Committee hearings and four unanimous votes in favor of enacting this important legislation.<br /><br />A significant increase in reimbursement is getting closer to a reality this Legislative Session. But to get us over the line, we cannot let up.<br /><br />Thank you to all of you that have emailed your respective members of the Florida House and Senate asking them to support SB 362 and HB 161. And thank you to those that had members on the Senate Fiscal Policy Committee that responded to our call to action and reached out asking for support in advance of the hearing this week. <title> Legislature Passes Civil Remedies Legislation</title>

<description><![CDATA[The Florida Senate passed HB 837 on March 23rd. A priority of the Governor, the legislation attempts to address the litigation climate in Florida. Recognizing the momentum behind the legislation, organized medicine focused our efforts on amending portions of the bill where possible to address physician and patient concerns. The primary impact for physicians will be in the realm of attorney fees and the calculation of medical damages. The legislation will limit attorney fee awards to those situations where there is a “total coverage denial of a claim”. This will limit the availability of attorney fees in cases of underpayments, which historically has been a mechanism for physicians to hold insurers accountable for reimbursing appropriately according to contractual or statutory provisions.<br /><br />The other area of impact will be how juries calculate medical damages in personal injury or wrongful death cases. HB 837 establishes what information will be provided to juries as they determine the value of uncompensated medical care already rendered and the cost of future medical care. Of note, for outstanding amounts owed for past or future medical care, if the injured party does not have heath insurance or Medicare or Medicaid, the jury will hear evidence of what that amount would be reimbursed at 120% of the Medicare fee schedule or 170% of the Medicaid fee schedule. Counsel for the plaintiff can also provide the jury any evidence of amounts actually billed to the patient. <description><![CDATA[<p style="text-align: left;"><strong><span style="font-size: 24px;">Hurricane Ian -- Key Medicaid Information for Fee-For-Service and Managed Care Providers</span></strong><br /><br /><strong><em>Content Provided by The Agency for Health Care Administration:</em></strong><br />It is imperative Florida Medicaid recipients maintain access to critical Medicaid services that are life sustaining (examples include; durable medical equipment and supplies, home health services, hospital services, nursing facility services, chemotherapy, dialysis services, etc.) (herein referred to as critical Medicaid services) during the disaster period.
